1. ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms“) govern your use of the Fast&Studious web application (the “Service“) provided by FAST&STUDIOUS, a French company with registered office located at 25 rue du Maréchal Foch, 78000 Versailles, France, registered under number 914 676 614 RCS Versailles (“we,” “us,” or “Company“).

By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. DESCRIPTION OF SERVICE

Fast&Studious is a web-based application that provides AI-powered project planning, modeling, and analysis tools. The Service integrates with various artificial intelligence models and large language models (LLMs) including but not limited to ChatGPT (OpenAI), Claude (Anthropic), and other AI services through their respective APIs.

Your data is hosted on OVH servers located in France/Europe. The Service is accessible through your web browser after creating an account and subscribing to one of our plans.

3. ACCOUNT REGISTRATION AND AUTHENTICATION

3.1 Account Creation

You can create an account using:

• Google authentication
• LinkedIn authentication
• Facebook authentication

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Updating your information when necessary
• Immediately notifying us of any unauthorized use

3.3 Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Service. By using the Service, you represent that you meet these requirements.

4. SUBSCRIPTION AND PAYMENTS

4.1 Subscription Plans

We offer multiple subscription plans with different prompt allowances and pricing:

Monthly Plans:

• Basic Plan: €20 per month – 20 AI prompts from scratch per month
• Premium Plan: €30 per month – 50 AI prompts from scratch per month

Daily Plan:

• Daily Plan: €5 per day – 5 AI prompts from scratch per day

When prompt limits are reached, you can continue using the Service with manual modifications only (no new AI prompts from scratch). A free version with limited capabilities is available to evaluate core functionality before subscribing.

4.2 Payment Processing

• Payments are processed securely through Stripe
• We accept major credit cards and other payment methods supported by Stripe
• All fees are charged in euros (€) unless otherwise specified
• Prices include applicable VAT where required

4.3 Billing and Renewal

• Monthly Plans: Subscriptions automatically renew every month on the same date you subscribed
• Daily Plan: Subscriptions automatically renew every 24 hours from the time of initial subscription
• You will be charged the current subscription fee for your selected plan
• We will notify you before any price changes take effect
• You can cancel your subscription at any time through your account settings
• Monthly Plans: Cancellation takes effect at the end of your current monthly billing period
• Daily Plan: Cancellation takes effect at the end of your current 24-hour period
• No refunds will be provided for early cancellation or unused prompts

4.4 Usage Limits and Prompt Allowances

• Each subscription plan includes a specific number of AI prompts from scratch per billing period
• Prompt limits reset at the beginning of each new billing period
• When your prompt limit is reached, you can continue using the Service but cannot generate new content from scratch using AI
• Manual modifications and editing of existing content remain available regardless of prompt usage
• Unused prompts do not carry over to the next billing period
• We reserve the right to monitor usage to prevent abuse of the prompt system### 9.6 General Disclaimers WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY WARRANTIES OR GUARANTEES WE PROVIDE ARE LIMITED TO AND CANNOT EXCEED THOSE PROVIDED BY OUR THIRD-PARTY SERVICE PROVIDERS (OVH, OPENAI, ANTHROPIC, STRIPE, ETC.).

4.5 No Refunds Policy

NO REFUNDS ARE PROVIDED. All sales are final. We provide a free version of our Service with limited capabilities that allows you to evaluate the core functionality before subscribing. By subscribing to a paid plan, you acknowledge that:

• You have had the opportunity to test the Service using our free version
• All payments are non-refundable
• No refunds will be issued for partial billing periods, unused prompts, or early cancellation
• This policy applies even in cases of account termination for violations of these Terms

4.6 Free Version

• We offer a separate free version of our Service with limited capabilities accessible via email
• The free version is completely separate from the paid web application
• Free version projects cannot be upgraded or transferred to the paid version
• To continue working on a free version project in the paid app, you must manually save your prompts and recreate the project
• We do not guarantee data retention for free version projects beyond one (1) week
• Free version access is provided via email without requiring account registration
• Free version terms and limitations may be modified at our discretion
• The free version is solely for evaluation purposes

5. USE OF THE SERVICE

5.1 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes. Access to AI prompts from scratch and certain features (such as document generation and manual updates) requires a paid subscription and is subject to the usage limits of your selected plan.

5.2 Acceptable Use

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Use the Service for any illegal or harmful purposes
• Share your account credentials with others
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools to access the Service without permission
• Generate content that violates third-party AI service policies
• Use the Service to create harmful, offensive, or inappropriate content
• Attempt to manipulate AI models to produce prohibited outputs
• Use the Service for purposes that violate OpenAI, Anthropic, or other AI providers’ terms of service

5.3 AI-Specific Usage Guidelines

When using AI features, you agree to:

• Use AI-generated content responsibly and ethically
• Verify the accuracy of AI outputs before relying on them
• Not use AI features to generate copyrighted content without permission
• Comply with all applicable AI ethics guidelines
• Not attempt to extract or reverse-engineer underlying AI models
• Understand that AI outputs may contain errors or biases

5.4 Content and Data

• You retain ownership of any content you upload or create using our Service
• You grant us a license to use, store, and process your content to provide the Service
• AI Processing: Your inputs may be processed by third-party AI services (OpenAI, Anthropic, etc.) subject to their respective privacy policies
• AI-generated outputs are provided to you under the terms allowed by the underlying AI service providers
• You are responsible for backing up your important data
• We are not responsible for any loss of your content or data
• You acknowledge that AI-generated content may not be original and should be reviewed before use

6. ARTIFICIAL INTELLIGENCE AND THIRD-PARTY SERVICES

6.1 AI Service Integration

Our Service integrates with various AI and machine learning services including:

• OpenAI (ChatGPT and other models)
• Anthropic (Claude)
• Other AI service providers as we may add them

6.2 Third-Party AI Terms

Your use of AI features is subject to the terms of service and privacy policies of the underlying AI providers. You agree to comply with:

• OpenAI’s Usage Policies and Terms of Service
• Anthropic’s Terms of Service and Acceptable Use Policy
• Any other AI service provider terms that may apply

6.3 AI Limitations and Disclaimers

You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or biases
• AI outputs should be reviewed and verified before use
• AI models may occasionally produce inappropriate or unexpected results
• We cannot guarantee the accuracy, completeness, or reliability of AI outputs
• AI services may be temporarily unavailable due to third-party service interruptions

6.4 Data Processing by AI Services

When you use AI features:

• Your inputs may be sent to third-party AI services for processing
• These services may have their own data retention and privacy policies
• We do not control how third-party AI services process your data
• You should review the privacy policies of OpenAI, Anthropic, and other AI providers

7. INTELLECTUAL PROPERTY

7.1 Our Property

The Service, including all software, designs, text, graphics, Excel online, generated documents and other content (excluding AI-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Service without written permission.

7.2 Your Content

You retain ownership of content you create, but grant us necessary rights to provide the Service. You represent that you have the right to upload and use any content you submit.

7.3 AI-Generated Content

• AI-generated content is subject to the intellectual property policies of the underlying AI service providers
• You may use AI-generated content according to the terms of the respective AI service providers
• We make no claims of ownership over AI-generated content
• You are responsible for ensuring AI-generated content does not infringe third-party rights

8. PRIVACY AND DATA PROTECTION

8.1 Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information and is incorporated into these Terms by reference.

8.2 Third-Party Authentication

When you use social login (Google, LinkedIn, Facebook), you authorize us to access certain information from these platforms as described in our Privacy Policy.

8.3 AI Service Data Processing

When you use AI features:

• Your prompts and inputs may be processed by third-party AI services
• Each AI service provider has its own privacy policy and data handling practices
• We recommend reviewing the privacy policies of OpenAI, Anthropic, and other AI providers
• Some AI services may retain data for their own improvement purposes

8.4 Data Hosting and Storage

• Your data is stored on OVH servers located in France/Europe
• Data storage and security are subject to OVH’s infrastructure capabilities and policies
• We implement reasonable security measures in addition to those provided by OVH
• Data backup and recovery depend on OVH’s hosting services and we implement reasonable redudancy backup measures.

8.5 Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security. Our security measures are limited to those we can implement on top of our hosting provider’s infrastructure. You use the Service at your own risk.

9. DISCLAIMERS AND LIMITATIONS

9.1 Service Availability

• The Service is provided “as is” without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We may temporarily suspend the Service for maintenance
• AI features depend on third-party services that may be unavailable
• Service availability depends on OVH hosting infrastructure

9.2 Third-Party Service Limitations

Our guarantees and service levels are strictly limited to those provided by our third-party service providers:

• Hosting: Service availability is limited to OVH’s uptime guarantees and infrastructure reliability
• AI Services: AI functionality is limited to the availability and performance of OpenAI, Anthropic, and other AI providers
• Payment Processing: Payment services are limited to Stripe’s service availability
• Authentication: Social login features depend on Google, LinkedIn, and Facebook service availability

9.3 AI-Specific Disclaimers

• AI-generated content is provided “as is” without warranties
• We do not guarantee the accuracy, reliability, or appropriateness of AI outputs
• AI models may produce biased, incorrect, or inappropriate content
• You use AI features at your own risk and should verify all outputs
• We are not responsible for decisions made based on AI-generated content

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• WE ARE NOT LIABLE FOR DATA LOSS, LOST PROFITS, OR BUSINESS INTERRUPTION
• WE ARE NOT LIABLE FOR ISSUES ARISING FROM THIRD-PARTY SERVICES (OVH, AI PROVIDERS, STRIPE, ETC.)
• WE ARE NOT LIABLE FOR ACTIONS TAKEN BASED ON AI-GENERATED CONTENT
• OUR LIABILITY CANNOT EXCEED THE LIABILITY OF OUR THIRD-PARTY SERVICE PROVIDERS

9.5 Infrastructure and Hosting Disclaimers

• We are not responsible for OVH server outages, data center issues, or infrastructure failures
• Data backup and recovery capabilities are limited to OVH’s services and our backup procedures
• We disclaim liability for any data loss due to hosting provider issues
• Network connectivity and performance depend on OVH’s infrastructure

9. TERMINATION

9.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

9.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay subscription fees
• Engage in fraudulent or illegal activities
• Use the Service in a way that harms our business or other users

9.3 Effect of Termination

Upon termination:

• Your access to the Service will cease
• You remain responsible for any outstanding fees
• We may delete your data after a reasonable retention period
• Provisions of these Terms that should survive will remain in effect

10. DISPUTE RESOLUTION

10.1 Governing Law

These Terms are governed by French law, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes will be resolved in the courts of Versailles, France.

10.3 Limitation Period

Any claims must be brought within one (1) year of the cause of action arising.

11. GENERAL PROVISIONS

11.1 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

11.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in full effect.

11.3 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

11.4 Assignment

You may not assign your rights under these Terms. We may assign our rights and obligations at any time.

11.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

• Authentication: Social login depends on Google, LinkedIn, and Facebook services
• We may add, remove, or replace third-party service providers at our discretion
• Changes to third-party services may affect Service functionality
• We are not responsible for third-party service policies, performance, or availability

12.3 AI Usage Monitoring and Limits

• We monitor AI prompt usage to enforce plan limits and prevent abuse
• Each plan has specific prompt allowances that reset according to the billing cycle
• Exceeding prompt limits will restrict new AI generation until the next billing period
• Attempts to circumvent usage limits may result in account suspension
• We reserve the right to implement additional usage restrictions or modify existing limits

12.4 Data Location and Compliance

• Data is primarily stored on OVH servers in France/Europe
• Data processing through AI services may involve servers in other jurisdictions
• You consent to data processing by our third-party service providers as necessary to provide the Service

12.3 Export Controls

You agree to comply with all applicable export and import laws and regulations.

12.4 Age Restrictions

If you are under 18, you must have parental consent to use the Service.

 

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
